GENERAL RENTAL CONDITIONS

The service "Rental of equipment" is provided by Roadbike Nice Côte d'Azur, (hereinafter referred to as the lessor). The rental conditions are an integral part of the rental contract. By accepting the general terms and conditions, the hirer confirms that he/she has read and fully accepted the rental conditions.

1. Taking over the equipment

The hirer takes over the equipment in good working order. The hirer is obliged to make any complaints to the lessor at the time of taking over the equipment.

2. Return of the equipment

The hirer is obliged to return the equipment to the lessor at the end of the rental period defined in the rental agreement and during opening hours. The equipment and all accessories provided by the lessor (helmets, etc.) must be returned to the lessor in perfect condition. If the hirer has lost or damaged accessories, these will be charged to him/her. Material damage will be charged at the published rates.

3. Extension of the rental period

An extension of the rental agreement is only possible with the consent of the lessor before the end of the current rental agreement. The lessor may refuse such an extension without giving any reason.

4. Minimum age of the hirer

The hirer must be of age.

5. Services and prices

The prices published by the lessor and in his brochures are valid.

6. Insurance

The hirer shall be responsible for insurance. By signing the rental agreement, the hirer confirms that he has adequately covered the risks associated with the use of the equipment. The equipment is not insured against theft and breakage.

6a. Loss of or Damage to Rental Bikes

The Client agrees to be solely responsible for the safe care, custody and operation of the road bikes during the rental period.

The Client agrees to return the road bike in the same condition received, ordinary wear and tear excepted. The Client agrees to ensure the bike is never left unattended, either locked or unlocked.

The client agrees to pay for any damage, including replacement parts to the bicycle, even if damage was caused by someone else. All repairs needed as a result of any such loss, destruction or damage, will be performed at the normal working rates. The parts in question including, but not limited to, handlebars, stem, bar tape, saddle support, saddle, wheels, derailleurs (front and rear), brakes (front and rear), brakes / speed levers (left, right), crankset, pedals (left / right), counter mount, pump, saddle bag.In the event the bicycle is lost, stolen, destroyed or damaged beyond repair, regardless of fault or cause, the Client agrees to pay Roadbike Nice Côte d'Azur the full replacement value of the equipment and that this may be as much as €5 000 (Five thousand Euros)

7. Helmets

An approved helmet is provided free of charge.

8. Responsibility of the hirer

The hirer undertakes to use the rented equipment with care, without danger to third parties and in accordance with the attached safety instructions. The hirer is always responsible for the physical and material damages which he causes at the time of the use of the rented equipment (art.1383 and 1384 of the civil code). Roadbike Nice Côte d'Azur will not engage its responsibility in case of damage or accidents undergone or caused by the hirer during the use of the rented equipment. The use in competition or for driving similar to a competition is forbidden. In the event of damage due to an accident, loss, theft or improper handling of the equipment, the hirer shall be liable for the costs of repair. In the event of total damage or loss, the hirer is liable for the replacement value of the equipment.

9. Security deposit

The lessor requires a credit card imprint, an identity document or a cheque as a deposit against loss, theft or damage to the equipment.

10. Applicable law

This contract is subject to French law. In the event of a dispute, in order to compare the points of view of the third parties and to enable them to find a solution to the dispute themselves, a mediator may be appointed by the parties or the judge beforehand. This mediation may then take two possible forms: conventional or judicial. In the event of mediation in the first instance and failure to resolve the dispute, the default court of jurisdiction would be that of the final lessee of the equipment. Upon agreement or in the event of different tenants and possible victims of damage, a single common court may be determined by the court.
